Insyte — Competitor Ad Intelligence Platform
1. Introduction
These Terms and Conditions (“Terms”) govern your access to and use of the Insyte platform (“Service”), operated by Insyte (“we”, “us”, or “our”).
By registering for or using the Service, you agree to be bound by these Terms. If you do not agree, you must not access or use the Service.
2. About Insyte
Insyte is a web-based marketing intelligence platform that enables users to:
- Search and analyse publicly available advertisements via the Meta Ads Library API
- Track competitor advertising activity and performance metrics
- Create, manage, and publish advertisements via Meta's Marketing API using OAuth authorisation
- Access analytics and insights to inform their own advertising strategies
3. Eligibility & Registration
3.1 Eligibility
The Service is intended for business and professional use only. You must be at least 18 years of age and have the legal authority to bind your organisation to these Terms.
3.2 Account Registration
You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
3.3 Business Use Only
Insyte is a B2B platform. Personal use or use by consumers outside a professional marketing context is not permitted.
4. Subscription & Payment
4.1 Subscription Plans
Insyte is offered on a monthly subscription basis. Pricing for each plan is displayed at the time of purchase and on our pricing page. All prices are exclusive of VAT where applicable.
4.2 Billing
Subscriptions are billed monthly in advance. Payment is processed automatically via our third-party payment processor. By subscribing, you authorise us to charge your payment method on a recurring basis.
4.3 Price Changes
We reserve the right to change subscription prices at any time. We will provide at least 15 days' written notice of any price increase. Continued use of the Service after the effective date constitutes acceptance of the new pricing.
4.4 Cooling-Off Period
As a UK-based service, if you are a consumer (which is unlikely given the B2B nature of the platform), you may have a statutory right to cancel within 14 days of your initial subscription under the Consumer Contracts Regulations 2013. However, by commencing use of the Service during this period, you acknowledge that the right to cancel may be lost.
4.5 Refunds
Subscription fees are non-refundable.
4.6 Taxes
You are responsible for any applicable taxes, duties, or levies imposed by your jurisdiction in connection with your use of the Service.
5. Acceptable Use
5.1 Permitted Use
You may use Insyte solely for lawful business purposes in connection with your marketing and advertising activities, in compliance with these Terms and all applicable laws.
5.2 Prohibited Use
You must not:
- Use the Service to violate any applicable law or regulation
- Scrape, crawl, or harvest data beyond what is expressly permitted by the Service
- Attempt to reverse-engineer, decompile, or disassemble the platform
- Use data obtained through Insyte for purposes other than your own advertising and marketing activities
- Commercially redistribute, resell, or sublicense data obtained through the Service without our written consent
- Use the Service to infringe the intellectual property rights of any third party
- Interfere with or disrupt the integrity or performance of the Service
- Use the Service to send unsolicited communications or spam
6. Meta Platform Integration
6.1 Meta Ads Library
Insyte integrates with the Meta Ads Library API to provide access to publicly available advertisement data. Use of this data is subject to Meta's Ads Library API Terms of Service in addition to these Terms. You agree not to use this data in ways that violate Meta's policies.
6.2 Meta Marketing API & OAuth
By connecting your Meta account(s) through our OAuth integration, you grant Insyte permission to access, manage, and publish advertisements on your behalf in accordance with the permissions you authorise. You remain solely responsible for:
- All advertisements published through your connected Meta accounts
- Ensuring your advertisements comply with Meta's Advertising Standards and Community Standards
- Any costs associated with your Meta ad campaigns
6.3 Meta Policy Compliance
You are solely responsible for ensuring that all advertisements you create or publish through Insyte comply with Meta's Advertising Policies, including rules relating to prohibited content, targeting restrictions, and data use. Insyte is not responsible for any advertisements rejected, suspended, or penalised by Meta.
6.4 API Dependency Disclaimer
Insyte's functionality depends on continued access to Meta's APIs. We do not guarantee uninterrupted access and shall not be liable for any disruption, limitation, or changes to Meta's APIs that affect the Service.
7. Intellectual Property
7.1 Our IP
All intellectual property rights in the Insyte platform, including software, design, trademarks, logos, and documentation, are owned by or licensed to Insyte. Nothing in these Terms grants you any rights in our intellectual property.
7.2 Your Content
You retain ownership of any content, data, or creative assets you upload to or create within the Service. By using the Service, you grant us a limited, non-exclusive licence to process and display your content solely for the purpose of providing the Service.
7.3 Third-Party Data
Data retrieved from the Meta Ads Library or other third-party sources is subject to the intellectual property rights and terms of those third parties. Insyte does not claim ownership of such data.
8. Limitation of Liability
To the maximum extent permitted by applicable law:
- Insyte is provided on an ‘as is’ and ‘as available’ basis without warranty of any kind
- We exclude all liability for indirect, incidental, special, consequential, or punitive damages
- Our total aggregate liability to you in connection with the Service shall not exceed the total subscription fees paid by you in the 12 months preceding the claim
- We are not liable for any loss of profits, revenue, data, or business opportunity
Nothing in these Terms limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded by law.
9. Termination
9.1 Termination by You
You may cancel your subscription at any time via your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to the Service until the end of the paid period.
9.2 Termination by Us
We may suspend or terminate your account immediately if you breach these Terms, fail to pay subscription fees, or if we are required to do so by law. We may also terminate the Service with 30 days' written notice for any business reason.
9.3 Effect of Termination
Upon termination, your right to use the Service ceases immediately. We will retain your data in accordance with our Privacy Policy and applicable law.
10. Governing Law & Disputes
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to any rights you may have as a consumer under applicable EU law.
11. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email or in-platform notification at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
